Thank you to Dr. Edwin Leap for saying in print what needed to be said. (“Theses for the Door of Emergency Medicine,” EMN 2011;33[10]:20; http://bit.ly/ThesesLeap.) The pain scale and EMTALA have caused far more damage than the problems they purported to fix. Unfortunately, the Patient Protection and Affordable Care Act, unless altered or scrapped, with its huge Medicaid expansion will codify pain scales and EMTALA and create a universal sense of entitlement to health care.

Physicians (and every other citizen) need to pay close attention to the Supreme Court this session and next year's presidential election.
